
DEPORTATION / REMOVAL PROCEEDINGS
Deportations, now called removal proceedings, may be initiated against any non-US citizen (including green card holders) for a variety of reasons. The most common trigger for removal proceedings are criminal charges and traffic violations. If someone commits certain crimes which are classified as removable, a conviction for such a crime may trigger removal proceedings. Also, if someone who in the United States unlawfully is stopped for speeding, it is possible that s/he will be requested to appear for the immigration hearing in the court even though s/he was only stopped for a minor traffic violation.
Being placed in removal proceedings does not mean that ICE will show at your doorstep and put you on a plane or in a van. It is a process which takes months or even years, with multiple court hearings. If you have any relief available, it usually takes a couple of years before you get a final resolution of your case.
Some eligible noncitizens that entered without inspection or documentation into the United States may be eligible for cancellation of removal. While the application is pending, you may obtain employment authorization to legally work. If approved for cancellation, you will become a green card holder.
